Education Law Center Statement on the Issuance of Federal Title IX Regulations

Education Law Center applauds the release of new Title IX regulations by the Biden Administration and urges the federal government, states, districts, and educational institutions to take greater steps toward protecting students from sexual and sex-based harassment and discrimination.

“Protecting students from sexual or sex-based harassment and discrimination is essential to ensure equal educational opportunity,” said Robert Kim, Executive Director of Education Law Center. “The Title IX regulations provide a useful roadmap for states, districts, and individual schools as they review their policies and procedures for responding to incidents. At the same time, they challenge the federal government, states, and local communities to make sure they are providing sufficient staffing and resources to enable schools not only to remediate past Title IX violations but to prevent future violations.”

The final regulations require federally funded education programs at both the K-12 and postsecondary levels to take prompt and effective action when notified of conduct that reasonably may constitute sexual or sex-based discrimination, including harassment, in their education programs or activities. The regulations also include groundbreaking protections for LGBTQ+ students and pregnant or parenting students. Additionally, they specify steps that schools must take to guarantee due process for all parties involved in the investigatory process.

In addition, the U.S. Department of Education has released a fact sheet, a summary of the major provisions of the final regulations, and a resource for drafting Title IX nondiscrimination policies, notices of nondiscrimination, and grievance procedures.
