A challenge to the constitutionality of NY’s local property tax cap is being reargued in State Supreme Court in Albany before Judge Eugene Devine, who is also presiding over NY's "Small Cities" school funding case. The tax cap, enacted in 2011, limits local property tax increases to support schools to 2% per year.
